"Where Do We Go From Here?"

America is in a heap of trouble.  We’ve got a new president who has an uphill battle against some of the most daunting challenges since FDR.  In addition to finding the best people to place in his cabinet and creating entirely new federal agencies to implement all the programs he promised, he has to keep the economy from slipping further into recession.  I don’t see why anybody would want to be the president who is going to be responsible for solving al the problems he’s going to be left with all at the same time.  If he succeeds, he’ll go down in history as a miracle worker.  If he fails, nobody will care how difficult the job was, they’ll only remember he failed.

He is going to have majorities in the House and Senate, so he’ll be able to get the laws he needs enacted quickly.  That is good news if the programs he initiates work, but bad news if he further disrupts the economy and creates even more tension among our international partners. Here’s a look at the current situation:

LEGAL PRE-FORECLOSURE AND DICOUNT MORTGAGE OPPORTUNITIES

Banks are loaded with thousands of foreclosed properties that they have to secure, maintain, insure and pay property taxes on.  They are holding back on foreclosures in hopes that they will get some kind of federal bailout, but much of what he proposes will only hurt them more.  For instance, bankruptcy judges are going to be given the authority to cram down loan balances to give broke home owners some slack at the expense of lenders.  How many lenders will be able to survive this? 

Another plan would allow non-paying home owners to stop payments for 90 days before they can be foreclosed.  That might create a terrific window of opportunity for pre-foreclosure buyers between the period when payments stop and foreclosure starts.  It should also make buying defaulted loans from distressed mortgage holders at deep discounts much easier.  For those who can wait for their money, this could create huge opportunities. 

The sub-prime melt down continues unabated.  Mortgage and credit card defaults continue to rise and banks continue to fail and be merged with stronger banks.  There will be a lot of consolidation and the survivors are going to want to unload foreclosed house inventories at bargain sale prices.  REO auctions are in full swing all over the country and opening bids are set very low.  Check out www.ushomeauction.com to find their locations and to review homes to be auctioned.  We’ve found some terrific bargains at these sales, the last being a 4/2/2 house in great shape for under $70,000. 

Investors in both the stock markets and bond markets are losing their shirts as the markets drift downward.  Its losses are in the trillions.  The FDIC has announced that it does not have enough money to pay back depositors if too many banks fail. 

Higher taxes are promised that would further depress the economy while increasing the amount wage earners would have to pay. 

If you read back over the foregoing you’ll see that those who buy houses are going to have a field day as prices continue to drift downward.  The day of the landlord has arrived.  When homeowners lose their upscale homes, they’ll look for comparable houses to rent.  That’s the market sector where most of the foreclosures are taking place.  Fortunately, banks will be unloading REO inventories at low enough prices to make upscale houses feasible as rentals to foreclosed homeowner who must rent. 

What makes all of this come together is the fact that cash-rich investors who are afraid of inflation, worried about taxes and unwilling to lose even more money in the stock market are going to have to turn to investment houses.  Entrepreneurs who use their money to buy foreclosed houses and REO’s at mere fractions of their replacement value, then lease/option them for cash flow and a portion of the future gain, will be able to create fortuned in the next couple of years.

He is currently developing 40,000 sq. ft of Commercial Flex Space and Burnt Store Preserve a 400 +   Unit Development on Burnt Store Road in Cape Coral.

C&W Development Group came together out of a need for a lending program to still allow investors to participate in growing real estate areas. There is no other product on the market like this today. We allow Stated Income, 10% Down, Investors and the ability to purchase Multiple Properties. We are not hard money lenders. Our background is that we have been in the Building, Real Estate and Mortgage business for 25+ Years. Once the lenders stopped the investor loans for new construction and development we had to find alternative financing. The Private Lending has allowed us do design programs for specific areas.

One of the Loan Programs we have created specifically for Mississippi Go-Zone area and those customers using MDA program. Our normal loan is a 3 Year Balloon, but because MDA required that the owner hold the property for 5 years we created the product to extend to 6 years.

"Millionaire Mailman"

Tom is an example of pursuing the American Dream of financial freedom. He started working for the Post Office as a mailman when he was just 19 years old and soon realized that the security entrapment of "good job" is not a lot different from a 30 year jail sentence. “You feel trapped, and your income is limited.”

Realizing his "good government job" was not going to make his dreams of being free come true, Tom took some real estate investing courses in the early 80's and bought his first house in 1983 at just 23 years old.

Tom soon realized that due to the nature of his mailman job, he had a valuable asset available to him that his real estate investor competition did not have. Think about it. What do mailmen do? They drive or walk around all day long and they look at houses!! Tom started buying up houses on his mail routes and networking with other letter carriers to refer to him vacant houses that provide an excellent source of leads that no one else knows about!!

When someone goes into foreclosure, before the Lis Pendens and the Complaint are filed, the only people who know that the house is headed for foreclosure are:   #1) - The borrower who cant make the payment,   #2) - The lender who didn't get the payment, and    #3) - The mailman who has to deliver the certified letter sent from the mortgage company to the borrower, and gets to walk up to the front door and stare the person on title right in the face!!

Tom said, "When I bought my first few houses, my fellow workers started teasing me and calling me "Millionaire Mailman!!"  While still walking his mail route, Tom built a portfolio of 25 "keeper" rental houses with positive cash flow and retired from his job at the ripe old age of 35.

Tom said, "When I finally quit my job, my fellow workers were coming back to me begging me to teach them how I did it. I had truly become the “Millionaire Mailman!!"

After Tom quit, he realized he no longer had the "inside scoop" on finding house deals from his old mailman job. So, Tom started an approach of building a mailman bird dog network finding him deals.

Tom says, "it all starts with buying the house at the right price. If you don’t do that up front, then nothing else is going to fall into place."

"When I go to investor clubs that are in hot markets, many investors are saying they are having a tough time finding deals, and some investors are tripping over each other trying to buy the same house!    “Yet, no one is utilizing a system like mine to eliminate the investor competition"

After 20 years of buying and holding and buying and selling, Tom has bought 250 properties, and truly lives the American dream.

Over the last 50 to 75 years there have only been a few chances to really clean up in real estate investing and the best one of these is unfolding right before our eyes.  It is quite literally a fire sale.

When asked about why he choose to write a book on short sales Graham answerers:

We were working on several deals at one month and we got another lead on a foreclosure. I was too busy to work on another short sale (I was working at a bank). I asked my wife Donna to handle the deal. She knew very little about how to negotiate with the bank, and I told her to just follow the steps on the checklist and that everything would be fine. Needless to say, she negotiated a great short sale on her very first try. She negotiated a home appraised at $123,000 with a $97,000 loan balance down to $68,000, and the home needed less than $10,000 in repairs.  That’s over $40,000 in equity after the repairs.

“If I can negotiate a short sale with one child on my hip, a child pulling at each leg, and nursing a newborn, then anyone can do it. Short sales are actually pretty simple. You just have to let the bank know that you are an investor who knows

Who Was The First Real Estate Millionaire?

It is notable that America’s first millionaire was a real estate investor. In the late 1700s, John Jacob Astor was a trader who made his money trading fur, silk, tea, and fine china. But in the 1830s, Astor started investing in New York real estate, and before long he became known as Manhattan’s landlord. He is probably one of the most dominant real estate investors of all time. In fact, when he died his estimated net worth was $20 million, which translates to approximately $450 Billion in today’s dollars. Astor’s story is not only inspiring but reinforcement that real estate will always be the greatest investment.

Don’t reinvent the wheel – make it go faster

One of the biggest mistakes many new and active investors make is their unprecedented need to reinvent real estate. Although I strongly believe you must do business differently than others to succeed, I do not think you need to change the way the game is played. Just use what’s there, make the wheel go faster, and put your personal touch on it. If you are going to succeed in the New Generation of Wealth and Success as it relates to real estate you need to abide my six principles of investing in real estate.

1) Always buy properties below market value regardless of market conditions.
2) Evaluate each real estate deal as if it were a business.
3) Shoot for the long term, but evaluate and write down every exit strategy.
4) A strong back office is more important than the property you buy.
5) Don’t try to be anything but yourself.
6) Keep investing in your education, no matter what the cost, as long as it relates to today’s market. Knowledge and credibility are your=2 0keys to success.
7) Investing in real estate with partners is the only way to go.

The secret to making money is making your money work for you, and in my opinion, real estate is the best way to achieve that. If the real estate can carry itself, enjoy the benefits of appreciation, and grow with partners you are well on your way to becoming a very big success. By the age of 27, I have bought and sold more than 500 properties in a four-year span without using my own money, and without credit or experience. That is nothing compared to what my students and I will accomplish over the next two to three years, as one of the greatest times to buy properties below market value is upon us.

Remember successful people are willing to do what unsuccessful people won’t. Success is not a matter of chance but a matter of choice, this is the time to make your move and I promise you that great wealth and success are upon you. How do I know this? Well I still spend 80% of my time buying and managing real estate in today’s market and this is one real estate wave I want to ride all the way to financial freedom.

"New Florida Land Trust Laws
and How to Use Them"

Learn from the pro, at the SREIA June meeting, when Jack Shea will review the new Florida Land Trust law that went into effect in October 2006 and was revised again in October 2007.  Jack is from Chicago where the Land Trust originated in 1892 and is the standard way of holding real estate.

Jack and attorney Mark Warda, who is also from Illinois, have been working together on trust matters in Florida for over 20 years.

There are several items in the new law that is of importance to real estate investors.  The changes expand and clarify the original 1963 law, which was very brief.  These revisions include new trustee functions, new director duties and new homestead rules. The law clearly states that every Florida resident may have a Homestead Exemption on his personal residence.  Many counties had differing opinions on this topic and the law now clarifies it. 

Jack will also discuss how investors take full benefit of the law in using the trust as: 1) a management system 2) an estate planning tool 3) an asset protection device 4) a financing system 5) a syndication method.

The use of trusts allows the transfer, mortgaging, optioning and other transactions to be done privately and quickly without witnesses or notaries. You will see why investors capture the advantage of leasing, optioning, and lending without the necessity of foreclosure to reclaim a property.  These and many of the other benefits of the best land trust law in the U.S. will be presented and discussed with SREIA members.

Jack Shea was raised in Chicago and attended the University of Illinois where he received a BS degree in Engineering with a minor in business.  He spent seven years as an Air Force pilot flying four-engine transports.  He was an aircraft commander and flight examiner, and lived in France and Japan.

He spent over ten years in the aviation and technology industry serving as head of marketing, and as an officer for several New York Stock Exchange corporations.

After continuing with graduate studies in business and marketing, he was an adjunct professor in the MBA program for Florida Institute of Technology.

Jack moved to Florida in 1978, and began investing in real estate.  He is a licensed Realtor and Mortgage Broker.  He has done syndications and mobile home development.  He also has bought and sold mortgages and notes on personal property.  He has concentrated on buying and selling options on real estate, and has been an investor in single-family homes.  Jack operates a 1031 exchange facilitator business with his wife, Merle, and conducts classes and briefings on the details of tax-free sales and purchases.  A few of these ventures have even been successful.

Tribute To Bob Davis and Linda Mills

Bob Davis and Linda Mills have worked tirelessly for SREIA for almost two decades.  Both have also served on the board in many capacities and have been vital to the success of this association.
 
Linda has held every office on the board and is a past president who served two terms.  Besides all the committees and tasks she has done which are really too numerous to mention here, unless you have a lot of time you like to listen to me !  Linda is the one person who has been most responsible for bringing all of our speakers to the general meetings.  No small task in and of itself.  She has given of herself tirelessly and continuously through the years always with a smile and a quiet competence.  Besides doing all this, she has attended national conferences and cruises representing SREIA and is known to the real estate community throughout the country.  She has been a great asset and a key to how well SREIA has done in the past and will continue to do in the future.
 
Bob has been the quiet, competent man of the board who has done just about everything there is to do in this organization.  He has always stepped up to the plate every time no matter what it was each time he has been asked to do something. You have seen his name every month on  the "What you Missed" column in the newsletter. He has attended just about every meeting we have ever had and helps set up and take down the room. He also has been one of the most instrumental people in designing and maintaining our SREIA web site. He has been a truly outstanding volunteer and colleague.
 
We are deeply in debt to their service, their unwavering loyalty and friendship, their inexhaustible energy, and their wise council. They are truly outstanding volunteers and SREIA is all the better for it. All we can say is: thank you, thank you, thank you.  If you ask what I would say to describe them in a few simple words I'd like to take a phrase coined from Kelly Ring and John Wilson on channel 13.  Quite simply Linda and Bob, you are truly two shining examples of "What's right with Tampa Bay!".

What is My Exit Plan?

David Fabian graduated in 1992 from the University of South Florida with B.S. degree concentrating in Accounting.  Shortly thereafter he became a Certified Public Accountant and spent 10 years with several different companies in both the Public and Private Sector. 

He bought his first rental in 1996 in Winter Haven Florida and he and his wife, Sabrina, continued buying 4 rentals every year while working their full time jobs as C.P.A’s.

In the year 2001, Dave and his wife partnered with another investor and did their first full Rehab and subsequent “Flip”.    Shortly thereafter they both quit their jobs and went full time into real estate. 

David currently works with his partners out of their West Tampa office building and purchases 3 or 4 properties per month while his wife is a full-time Mom to their 7 year old daughter and 4 year old son.

Chuck Collova went to work for Franklin Credit in Cincinnati, Ohio on August 23, 1966, as a 20 year old trainee collecting past due accounts, skip tracing and working for one of the few finance companies in the State that was making mortgage loans. He went to GE Credit Corporation (now GE Capital) in 1969. After seven physical moves and promotions in an eight year period starting as a Branch Manager, Senior Auditor, District Manager and became the National Operations Manager for the Home Modernization division based in Pittsburgh, Pa which was responsible for home improvement loans and first and second mortgages. Chuck left GE in 1979 and came back to Florida working in the mortgage brokerage industry as marketing and operations manager for a California based firm. In 1981 he opened his own mortgage brokerage business, C&C Financial Services, Inc now located @ 4127 W. Cypress St, Tampa, Fl. 33607.

Chuck had purchased his first home in 1967 and became a serious real estate investor in 1984.  He has purchased numerous residential, several commercial, and one industrial property over the years.  He also has a wholesaling company and works in both businesses with his oldest son Sonny.  Chuck was one of the first three original vendors of SREIA and our first platinum vendor.  He is the Vendor Liaison and had served on the Board of SREIA as both director and Treasurer for the last two years.

Jack Miller is an active investor who specializes in single family houses however, he has bought, sold or held for investment over 500 properties including apartments, mobile home parks, office buildings, development land, hundreds of time shares, over 1 million in mortgage paper, businesses, commercial property, and land leases spread over 21 states from Hawaii to Maine and Florida to Oregon.  More significantly, all but one property were bought without a single institutional loan being placed on the property and without any personal loan guarantees or personal financial liability.

          Jack Miller started the first seminar on single family house investing in 1975 and his course textbooks on Options, Management, and Trusts represent the standard of the industry.   Since 1978, he has personally written and published his monthly investment newsletter,  The CommonWealth Letters, and he continues to present monthly seminars around the country.

Wayne Brown has been a real estate appraiser for over 30 years in the Tampa Bay Area appraising properties from single family residential lots to multi-use high rise buildings in Philadelphia.

Wayne worked for three different banks and lending institutions as their senior review appraiser. Wayne also worked for HUD appraising apartment buildings on a national basis.

Wayne is actively involved in doing appraisals for REO foreclosures for banks and financial institutions.

Prior to his appraisal career, Wayne was a social worker for child abuse and a federal agent with Department of Justice.

According to Wayne, the real estate market we have today is because the investors were fueling the market, and they were the ones that were the driving force behind the market that resulted in substantial increases in value that we saw for a few years. Now, we have a different market and one of the main reasons for the change is investors have basically jumped out of the market and that along with the interest rate increase is what has happened.

So, how do we deal with the market we have now? What helps sell a property? What adds value to a house? Where does square feet play a part? Does landscaping really have a big impact? Which comparative sales should be pertinent to the value you may ask for your house?

Andy Heller Neither Andy Heller nor his real estate partner Scott Frank, ever intended to become full time real estate investors.  However, in their approximately 40 years of combined real estate investing, they have developed a long term real estate investing strategy that has allowed them to make loads of money while minimizing their time, effort and headaches.

On a part-time basis, while involved in successful non-real estate careers and putting their families first, Scott and Andy have bought, rented and sold approximately 100 homes. Nena Gang, EVP of the Bay Area Apartment Association will be joining us for her annual review of the "Joys of Landlording" and how avoid the pitfalls and pot holes of the rental industry. 

Nena Gang is the CEO of GMS Group, an association management and consulting firm located in Tampa, Florida.

GMS Group currently partners with seven non-profit trade associations, including the Bay Area Apartment Association.  GMS has been involved in association management since the early 80's.

In recent years, Nena has devoted significant time to developing and teaching adult learner programs.  These seminars/workshops are interactive and focus on ‘reality’ training for the industry professional.  Current programs include, OSHA lock out tag out, sales and marketing, anger management, customer service, curb appeal and five fair housing seminars.

In addition to free standing seminars, Nena also teaches the NALP, CAM and CAM-T programs which are accredited through the National Apartment Association.

GMS Group offers full service management services to its clients including a government affairs division that monitors and assists GMS clients lobbyists at
the state and local level in addition to working with local government and other agencies.

Gang credits her staff for ‘covering’ for her and providing her the opportunities to travel and take part in government affairs and other learning adventures.

Andrea is President of 1031 Property Exchange, Inc., offering services as a qualified intermediary.  Allan is an accountant specializing in taxation, real estate, corporate structuring and tax matters related to all phases of real estate ownership and investing.  Allan works with business owners and real estate investors throughout the United States. Both are real estate investors and knowledgeable about the ins and outs of real estate investing and taxation.  They believe that an essential key to life is to “become skillful enough to be able to do rewarding things.”    

There talk will center on the merits of using 1031 Tax Free Exchanges when selling investment real estate in order to “keep your equity working for you”.  Other topics will be tax aspects of investing in real estate.

Come with your questions and note pads.  This is informative and presented in a pro-active style that will keep you awake and more importantly, WILL increase your business!

How do you find, evaluate, lease, and keep a quality tenant?  What can you do to ensure everything goes right?  What can happen if you don't screen your tenants?  What can you do if your tenant turns out to be less than desirable? 

Want to save a bundle?  What criteria are you using?  Do you like pets?  How do you make sure you don't get into trouble?  How can you limit your exposure? 

Come find out answers to these questions and many more as SREIA president Dave Marek and secretary Bob Davis talk about the adventures you can have in owning and renting out or leasing a property.  It will be a first-hand look at methodologies, techniques and the hands on experience of two very experienced investor property managers.  There will also be some great information handed out, so don't miss it.

Every time we leave our homes, we expect to return and find it in exactly the same condition as when we left it. When we return to find disaster has struck, we are left emotionally distraught and facing financial peril. Whether we are homeowners, business owners or landlords, no one is prepared for disaster.
