"New Florida Land Trust Laws
and How to Use Them"

Learn from the pro, at the SREIA June meeting, when Jack Shea will review the new Florida Land Trust law that went into effect in October 2006 and was revised again in October 2007.  Jack is from Chicago where the Land Trust originated in 1892 and is the standard way of holding real estate.

Jack and attorney Mark Warda, who is also from Illinois, have been working together on trust matters in Florida for over 20 years.

There are several items in the new law that is of importance to real estate investors.  The changes expand and clarify the original 1963 law, which was very brief.  These revisions include new trustee functions, new director duties and new homestead rules. The law clearly states that every Florida resident may have a Homestead Exemption on his personal residence.  Many counties had differing opinions on this topic and the law now clarifies it. 

Jack will also discuss how investors take full benefit of the law in using the trust as: 1) a management system 2) an estate planning tool 3) an asset protection device 4) a financing system 5) a syndication method.

The use of trusts allows the transfer, mortgaging, optioning and other transactions to be done privately and quickly without witnesses or notaries. You will see why investors capture the advantage of leasing, optioning, and lending without the necessity of foreclosure to reclaim a property.  These and many of the other benefits of the best land trust law in the U.S. will be presented and discussed with SREIA members.

Jack Shea was raised in Chicago and attended the University of Illinois where he received a BS degree in Engineering with a minor in business.  He spent seven years as an Air Force pilot flying four-engine transports.  He was an aircraft commander and flight examiner, and lived in France and Japan.

He spent over ten years in the aviation and technology industry serving as head of marketing, and as an officer for several New York Stock Exchange corporations.

After continuing with graduate studies in business and marketing, he was an adjunct professor in the MBA program for Florida Institute of Technology.

Jack moved to Florida in 1978, and began investing in real estate.  He is a licensed Realtor and Mortgage Broker.  He has done syndications and mobile home development.  He also has bought and sold mortgages and notes on personal property.  He has concentrated on buying and selling options on real estate, and has been an investor in single-family homes.  Jack operates a 1031 exchange facilitator business with his wife, Merle, and conducts classes and briefings on the details of tax-free sales and purchases.  A few of these ventures have even been successful.

Jack has written and taught classes on Land Trusts with attorney, Mark Warda.  He also has written and taught on lease-purchase contracts, 1031 exchanges, and mortgage investments.  Bring your questions and join the discussion.

Tribute To Bob Davis and Linda Mills

Bob Davis and Linda Mills have worked tirelessly for SREIA for almost two decades.  Both have also served on the board in many capacities and have been vital to the success of this association.
 
Linda has held every office on the board and is a past president who served two terms.  Besides all the committees and tasks she has done which are really too numerous to mention here, unless you have a lot of time you like to listen to me !  Linda is the one person who has been most responsible for bringing all of our speakers to the general meetings.  No small task in and of itself.  She has given of herself tirelessly and continuously through the years always with a smile and a quiet competence.  Besides doing all this, she has attended national conferences and cruises representing SREIA and is known to the real estate community throughout the country.  She has been a great asset and a key to how well SREIA has done in the past and will continue to do in the future.
 
Bob has been the quiet, competent man of the board who has done just about everything there is to do in this organization.  He has always stepped up to the plate every time no matter what it was each time he has been asked to do something. You have seen his name every month on  the "What you Missed" column in the newsletter. He has attended just about every meeting we have ever had and helps set up and take down the room. He also has been one of the most instrumental people in designing and maintaining our SREIA web site. He has been a truly outstanding volunteer and colleague.
 
We are deeply in debt to their service, their unwavering loyalty and friendship, their inexhaustible energy, and their wise council. They are truly outstanding volunteers and SREIA is all the better for it. All we can say is: thank you, thank you, thank you.  If you ask what I would say to describe them in a few simple words I'd like to take a phrase coined from Kelly Ring and John Wilson on channel 13.  Quite simply Linda and Bob, you are truly two shining examples of "What's right with Tampa Bay!".

What is My Exit Plan?

David Fabian graduated in 1992 from the University of South Florida with B.S. degree concentrating in Accounting.  Shortly thereafter he became a Certified Public Accountant and spent 10 years with several different companies in both the Public and Private Sector. 

He bought his first rental in 1996 in Winter Haven Florida and he and his wife, Sabrina, continued buying 4 rentals every year while working their full time jobs as C.P.A’s.

In the year 2001, Dave and his wife partnered with another investor and did their first full Rehab and subsequent “Flip”.    Shortly thereafter they both quit their jobs and went full time into real estate. 

David currently works with his partners out of their West Tampa office building and purchases 3 or 4 properties per month while his wife is a full-time Mom to their 7 year old daughter and 4 year old son.

Chuck Collova went to work for Franklin Credit in Cincinnati, Ohio on August 23, 1966, as a 20 year old trainee collecting past due accounts, skip tracing and working for one of the few finance companies in the State that was making mortgage loans. He went to GE Credit Corporation (now GE Capital) in 1969. After seven physical moves and promotions in an eight year period starting as a Branch Manager, Senior Auditor, District Manager and became the National Operations Manager for the Home Modernization division based in Pittsburgh, Pa which was responsible for home improvement loans and first and second mortgages. Chuck left GE in 1979 and came back to Florida working in the mortgage brokerage industry as marketing and operations manager for a California based firm. In 1981 he opened his own mortgage brokerage business, C&C Financial Services, Inc now located @ 4127 W. Cypress St, Tampa, Fl. 33607.

Chuck had purchased his first home in 1967 and became a serious real estate investor in 1984.  He has purchased numerous residential, several commercial, and one industrial property over the years.  He also has a wholesaling company and works in both businesses with his oldest son Sonny.  Chuck was one of the first three original vendors of SREIA and our first platinum vendor.  He is the Vendor Liaison and had served on the Board of SREIA as both director and Treasurer for the last two years.

Jack Miller is an active investor who specializes in single family houses however, he has bought, sold or held for investment over 500 properties including apartments, mobile home parks, office buildings, development land, hundreds of time shares, over 1 million in mortgage paper, businesses, commercial property, and land leases spread over 21 states from Hawaii to Maine and Florida to Oregon.  More significantly, all but one property were bought without a single institutional loan being placed on the property and without any personal loan guarantees or personal financial liability.

          Jack Miller started the first seminar on single family house investing in 1975 and his course textbooks on Options, Management, and Trusts represent the standard of the industry.   Since 1978, he has personally written and published his monthly investment newsletter,  The CommonWealth Letters, and he continues to present monthly seminars around the country.

Wayne Brown has been a real estate appraiser for over 30 years in the Tampa Bay Area appraising properties from single family residential lots to multi-use high rise buildings in Philadelphia.

Wayne worked for three different banks and lending institutions as their senior review appraiser. Wayne also worked for HUD appraising apartment buildings on a national basis.

Wayne is actively involved in doing appraisals for REO foreclosures for banks and financial institutions.

Prior to his appraisal career, Wayne was a social worker for child abuse and a federal agent with Department of Justice.

According to Wayne, the real estate market we have today is because the investors were fueling the market, and they were the ones that were the driving force behind the market that resulted in substantial increases in value that we saw for a few years. Now, we have a different market and one of the main reasons for the change is investors have basically jumped out of the market and that along with the interest rate increase is what has happened.

So, how do we deal with the market we have now? What helps sell a property? What adds value to a house? Where does square feet play a part? Does landscaping really have a big impact? Which comparative sales should be pertinent to the value you may ask for your house?

Andy Heller Neither Andy Heller nor his real estate partner Scott Frank, ever intended to become full time real estate investors.  However, in their approximately 40 years of combined real estate investing, they have developed a long term real estate investing strategy that has allowed them to make loads of money while minimizing their time, effort and headaches.

On a part-time basis, while involved in successful non-real estate careers and putting their families first, Scott and Andy have bought, rented and sold approximately 100 homes. Additionally, in many years, they have made more money in their 2-5 hour a week “side real estate investing job” than in their 40+ hour per week day job.

Over the years, Andy and Scott learned a lot.  They eventually developed the “Buy Low, Rent Smart, Sell High” program, which is a grounded and realistic wealth generating method. GMS Group currently partners with seven non-profit trade associations, including the Bay Area Apartment Association.  GMS has been involved in association management since the early 80's.

In recent years, Nena has devoted significant time to developing and teaching adult learner programs.  These seminars/workshops are interactive and focus on ‘reality’ training for the industry professional.  Current programs include, OSHA lock out tag out, sales and marketing, anger management, customer service, curb appeal and five fair housing seminars.
